1.    I, the undersigned participant, hereby represent that I am 18 years of age or over.

2.    I understand that my employer, or contracting company if I am an independent contractor, has engaged Health Yoga Life, LLC (“HYL”), to provide company employees and contractors with access to yoga and other movement classes, meditation training, seminars and other Wellness events (“HYL content).

3.  I understand and agree that HYL content is protected by copyright law, and that the copying, selling and sharing of HYL content. is prohibited.

4.  I agree that it is my sole responsibility to consult with my physician prior to commencing any yoga-based exercise program and to follow such physician’s advice regarding my exercise program and any existing and/or potential health complications, including pregnancy, I may have. I agree to remain under medical supervision if my physician so advises. If I am injured or have any adverse change in my health, I agree that it is my sole responsibility to obtain medical assistance.

5.  I understand that there is an inherent risk of injury and other harmful effects in any yoga-based exercise program, particularly if I am pregnant. In addition, I acknowledge that my use of HYL offerings through ZOOM and/or other on-line platforms does not permit the kind of personal oversight by an instructor that would be possible in a studio setting. Accordingly, I acknowledge that I am voluntarily participating in HYL offerings with full knowledge that there is risk of damage, personal injury, or death.

6.  In consideration for being allowed to participate in the activities offered by HYL, I do hereby fully and irrevocably release and discharge HYL, my employer, or contracting company if I am an independent contractor its owners, agents, members, employees, instructors, volunteers, and legal representatives (herein, “HYL”), for and from all claims and causes of action, known or unknown, anticipated or unanticipated, which I, my successors, heirs, assigns, or legal representatives, hereafter may have resulting from or in any way connected to participating in HYL yoga classes or other offerings, or following yoga course instructions whether caused by negligence, hazards known, unknown, or otherwise.

7.  I accept financial responsibility for any injury that I may cause to myself or my surroundings due to my own negligence or intentional act or omission while participating in offerings of HYL and I agree to indemnify and hold harmless HYL,  my employer, or contracting company if I am an independent contractor, from liability for any injury, death, or damage that may result from my participation.

8.  I acknowledge that I am solely responsible to ensure my privacy, and that of those in my surroundings, while I take advantage of HYL offerings on ZOOM or other on-line platforms, and I hereby release and discharge HYL for and from any harm that might come from release of video images or audio during HYL yoga or other sessions online.

9.  I acknowledge that I have fully read and understand the foregoing waiver and release form.  I understand that by signing this agreement I am giving up certain legal rights, that I, my successors, heirs, assigns, or legal representatives may have against the parties released herein, including without limitation the right to sue HYL, my employer or contracting company if I am an independent contractor. I acknowledge that I am signing this agreement voluntarily and intend by my signature for this to be a complete and unconditional release of liability as outlined herein.
